Terms of Service and Rules for Use of IKA POLSKA Online Shop


1.General Terms and Conditions

These terms of service (hereinafter "TOS") specify the rules for rendering service and use of the online shop available under the Internet address

1.1. IKA POLSKA Online Shop is managed and run by IKA POLSKA Spółka z ograniczoną odpowiedzialnością Sp. k. entered into the National Court Register under the number 0000346531 (Administrator).

1.2. You can contact Online Shop www.ika.pl at telephone number 61 6531080, via e-mail at sklep@ika.pl, and with the use of the contact form available on the website under "Contact".

1.3. These TOS are the rules for rendering e-service as provided for in Art. 8 of the act of 18th July 2002 on rendering e-services (Journal of Laws of 2002 No. 144, item 1204 as amended).

1.4. To matters which are not covered in TOS, the common Polish regulations shall apply, in particular the regulations of the Civil Code, the act on rendering e-service, the act on protection of certain consumer rights and liability for damages caused by dangerous products, the act on specific conditions of consumer sales and on the amendment of the Civil Code, the act on copyrights and similar rights and the act on personal data protection.

1.5. Before the use of IKA POLSKA online shop, all users are obliged to read TOS.

1.6. IKA POLSKA Online Shop and its respective elements are subject to legal protection.

2. Terms and phrases used in these TOS shall have the following meaning:

2.1. Administrator – the entity which manages and runs IKA POLSKA Spółka z ograniczoną odpowiedzialnością Sp. k.

2.2. www.ika.pl Online Shop – an Internet service run by Administrator in the Polish language and it's the respective elements maintained by Administrator in www.ika.pl domain, allowing rendering Services - purchase of Products through the Internet.

2.3. Service – payable operation provided by Administrator within IKA POLSKA Online Shop through the Internet and consisting in selling Products.

2.4. Product/s – goods available in the online shop.

2.5. Lead Time - the time required by IKA POLSKA Online Shop to complete an order and dispatch it with the use of shipment or receipt method chosen by the Buyer.

2.6. User – it is a natural person aged 18+ with full powers to perform legal actions, a legal person or an entity without legal personality but able to contract obligations and acquire rights on its own behalf, who has established Account, including as Consumer or Entrepreneur.

2.7. Consumer – it is a natural person performing a legal action which is not directly related to his or her business or professional activity, as provided for in Art. 221 of the Civil Code.

2.8. Entrepreneur – it is a natural person, a legal person or an organisation unit which is not a legal person who is granted legal capacity by virtue of the act, and who runs business or professional activity on his or her behalf.

2.9. Buyer - it is a registered User of IKA POLSKA Online Shop, who has made a purchase in IKA POLSKA Online Shop by selecting Product, providing his or her details as required for the delivery, accepting the order and paying the purchase price. Both Consumer and Entrepreneur can be Buyers.

2.10. Login (User's name) – a string of characters being a unique designation of User that allows his or her identification in IKA POLSKA Online Shop, selected by the User during Registration and consisting of at least 5 characters, i.e. small and capital letters (a-z or A-Z) without Polish diacritical marks, numbers and/or special signs.

2.11. Password – a unique string of characters used for signing in to IKA POLSKA Online Shop, selected by User during Registration, which however may be changed later in Account settings, and consisting of at least 8 characters, i.e. small and capital letters (a-z or A-Z) without Polish diacritical marks, numbers and/or special signs.

2.12. Account – the right to access IKA POLSKA Online Shop resources made available, free of charge, to User by Administrator, used to store User's details as provided by the User, information on User's operations within the service, kept by Administrator for the User under a unique User name (login), the use of which requires registration and signing in with the use of login and password.

2.13. Registration - it is a free of charge procedure of creating Account in IKA POLSKA Online Shop and acceptance of TOS.

2.14. Terms of Service - these TOS.

3. Conditions of use of IKA Polska Online Shop

3.1. In order to start the use of IKA POLSKA Online Shop it is required to register by filling out the registration form available on IKA POLSKA Online Shop website (purchase with registration) or to start the ordering process by providing personal data and address information (purchase without registration).

3.2. Acceptance of TOS by User is tantamount to expressing consent to processing User's personal data provided in the registration form by Administrator for the purpose of proper performance of the agreement on rendering e-service, receiving trade information from Administrator and his partners, receiving system generated messages, messages sent by Administrator and any information on obstacles, changes or maintenance breaks in operation of IKA POLSKA Online Shop.

3.3. The use of IKA POLSKA Online Shop is considered an acceptance of TOS. Signing in to IKA POLSKA Online Shop is considered an acceptance of TOC in the version valid at that time.

3.4. IKA POLSKA Online Shop renders Services within the scope and under terms and conditions specified in TOS.

3.5. TOS are made available to Users free of charge through IKA POLSKA Online Shop in a manner that allows their downloading, saving and printing out.

3.6. Administrator shall use his best efforts to keep the IKA POLSKA Online Shop functioning in a continuous manner. Administrator makes a reservation that some breaks in operation of IKA POLSKA Online Shop may occur, in particular due to data updating, system repairs or other maintenance works, which shall be communicated by Administrator with information on IKA POLSKA Online Shop website in advance.

3.7. Services are rendered by Administrator through IKA POLSKA Online Shop by the time they are suspended or ceased by Administrator. Administrator is entitled to suspend or cease rendering Services without prior notice to Users, with the reservation that the rights of Buyers who paid for Service shall be observed at all times.

3.8. To use Services offered by Administrator within IKA POLSKA Online Shop properly and to the full extent Users shall need a computer with Internet access, appropriate software and web browser installed, as well as e-mail account operated on any server; the use of some applications of IKA POLSKA Online Shop might require installation of such software as Java, Java Script etc.

3.9. When rendering Service, Administrator is not an Internet provider. In order to make use of Services, User shall get access to the Internet at his or her own account.

3.10. In order to ensure secure communication with regard to Service, Administrator shall apply technical and organisational measures adequate to the level of security threat of the Service rendered.

3.11. One of the basic threats for each user of the Internet, including the persons using e-services, is the possibility to "infect" ICT system by software created solely for the purpose of causing damage, such as e.g. viruses, worms or Trojan horses. To avoid similar threats it is important for User to install an anti-virus program on the computer used to connect to the Internet, and to keep it updated by installing the updates and new releases as soon as they are available on the market. Administrator also informs that special threats concerning the use of services rendered online, and described in TOS, shall also include the operation of the so called hackers who try to break in to both Administrator's and User's systems. User hereby is made aware that despite various, modern "protective" technologies applied by Administrator no perfect protection against the adverse actions described hereinabove exists.

3.12. Administrator represents that while rendering services specified in these TOS, User is forbidden to deliver illegal content. By accepting TOS User represents with the same that he or she shall not violate the above ban.

3.13. Price lists or advertisements displayed in IKA POLSKA Online Shop are published for information purposes only and shall not be considered a trade offer, according to the regulations of the Civil Code. They only invite to negotiation, according to Art. 71 of the Civil Code.

3.14. IKA POLSKA Online Shop shall not be liable for discrepancies in the looks or colours of Products as compared with the products received, which are due to technical reasons or to differences in displaying Products' colours on different computers, as well as the differences attributable to the specific nature of Product, i.e. e.g. glass structure or density, etc.

3.15. IKA POLSKA Online Shop allows the possibility of temporary unavailability of Products in colours, sizes and quantities requested by the Buyer.

3.16. IKA POLSKA Online Shop and its respective elements, in particular its name, concept, graphic design, database and industrial property rights, including trademarks, is and shall remain the property of Administrator or other entities with whom the Administrator entered into appropriate agreements, and as such shall be subject to legal protection.

3.17. All Products and their names are used for identification purposes and may be reserved trademarks of their respective owners.

3.18. Pictures presenting Products and displayed on the IKA POLSKA Online Shop website are used for illustration only and may not present the actual look of Product/s and all the details. IKA POLSKA Online Shop operators are willing to answer any questions or doubts concerning the look of Product/s and its/their technical parameters and other features, and if needed, to send pictures or drawings via e-mail that might dissipate the doubts.

3.19. Product which IKA POLSKA Online Shop has in stock shall be delivered within 3 business days from the date of order confirmation by IKA POLSKA Online Shop. Products made to special order shall be delivered within the term agreed individually, which shall be communicated to the Buyer within 2 business days from placing an order and included in the terms and conditions of order execution.

4. Acceptance and execution of order

4.1. Customer is free to place orders 7 (seven) days a week and 24 (twenty four) hours a day via the website www.ika.pl . After having registered (button "Register") and signing in to the above mentioned website, Customer shall receive an e-mail sent to the e-mail address provided during registration with confirmation that his or her account has been successfully created. It is also possible to do shopping in IKA POLSKA Online Shop without the need to register.

4.2. In the next step Customer places an order by indicating the product he or she is interested in, by pressing the button "ADD TO BASKET" on the product site, and then by indicating the method of shipment/collection and method of payment and confirming the order in the Basket.

4.3. Customer is required to indicate in the Basket :
a) Products ordered (including their quantity and type);
b) delivery address;
c) type of the accounting document confirming the selling transaction: receipt or VAT invoice;
d) delivery method;
e) payment method;
f) discount code (option).

4.4. After having read the TOS and accepted the terms and conditions, Customer places an order by clicking the command "I'M PLACING THE ORDER".

4.5. As soon as the order is placed (the order is registered in the selling system of IKA POLSKA Online Shop by the shop personnel) Customer receives an e-mail with confirmation that his or her order has been successfully placed. Seller reserves the right to e.g. confirm an order on the phone.

4.6. Sales agreement is concluded at the moment IKA POLSKA Online Shop confirms that purchase order has been accepted.

4.7. IKA POLSKA Online Shop initiates completion of an order:
a. for orders placed in the procedure of COD (cash on delivery), immediately after receiving the purchase order from the User.
b. for orders placed with payment method by bank transfer, as soon as the payment made by the User is credited to the bank account of IKA POLSKA Online Shop indicated in the order. Customer is obliged to quote PO's number, name and surname of the Customer, following the pattern provided in the e-mail confirming the PO, in transfer description field. Otherwise lead time may be extended.

4.8. IKA POLSKA Online Shop reserves the right to verify each PO. An order shall be deemed placed only if it contains all data allowing proper identification of the User, in particular his or her telephone number and e-mail address.

4.9. Should a Product be not available (be out of stock or not available at the suppliers' of IKA POLSKA Online Shop) and there is no possibility to complete User's order within 14 calendar days of the date of conclusion of the Agreement, IKA POLSKA Online Shop shall have the right to withdraw from the Agreement. If such be the case, IKA POLSKA Online Shop shall notify the Buyer, within 14 calendar days of the date of conclusion of the Agreement at the latest, that it is not possible to complete the order and reimburse to the Buyer full payment received from him or her.

4.10. Should some of the ordered Products be not available and therefore the completion of order would not be possible within this scope within 14 calendar days, the Buyer shall be notified by IKA POLSKA Online Shop personnel of the progress of the order and shall decide on the method of completion (partial delivery or cancellation of the entire order).

4.11. Only limited quantity of Products will be sold in promotion or sales, and therefore confirmed orders will be fulfilled on a first-come, first-served basis until we run out of stock of Products covered by this form of selling. Should we run out of stock of Products in promotion or sale, User will be notified by IKA POLSKA Online Shop. If such be the case, IKA POLSKA Online Shop shall be entitled to exercise the right to withdraw from the agreement.

4.12. Each order is followed by the issuance of a receipt or VAT invoice, at User's discretion communicated in the purchase order.

4.13. IKA POLSKA Online Shop reserves the right to reject an order if the previous cooperation record undermines Customer's credibility and reliability.

5. Purchase without registration

5.1. An entity interested in one-off, quick shopping in IKA POLSKA Online Shop (skipping the process of registration and signing in to IKA POLSKA Online Shop) selects Products of his or her interest, fills in the form "Purchase without registration", where he or she provides among other his or her e-mail address and telephone number (for the purpose of sending order confirmation and acceptance for completion or to allow contact in case some of the required data is missing. One should be aware, however, that in such case the entity: does not have a personal basket, is not able to track the progress of his or her order, cannot view the history of his or her previous orders and when placing another order he or she will be required to fill in all data anew.

5.2. With the reservation of terms specified herein and the nature of buying Products without registration, the provisions of these TOS and in particular the rules for processing personal data of Users who purchase Products shall accordingly apply to the entities buying Products without Registration. Granting the entities purchasing Products without Registration the full rights reserved for Users, according to TOS (including: tracking the progress of one's order, review of orders history, sending messages to IKA POLSKA Online Shop, possibility to post comments) may be made conditional upon Registration.

6. Changes in Purchase Orders

6.1. Any changes in purchase orders by User are only possible until the order is completed (i.e. until Products are delivered for shipment). User may withdraw a purchase order placed as a whole by the time it is shipped.]

6.2. Any amendments referred to hereinabove shall only be possible through the contact with IKA POLSKA Online Shop at sklep@ika.pl or at the telephone number +48 61 6531080. Amendments to a purchase order requested on the phone shall be implemented after User's verification as the holder of the Account used to place the order subject to amendment.

7. Product Prices

7.1. All Product prices quoted on the IKA POLSKA Online Shop website are in Polish zlotys and include VAT (gross price).

7.2. The price indicated beside each Product shall be binding at the moment of placing an order by User.

7.3. IKA POLSKA Online Shop reserves the right to change the prices of Products displayed on IKA POLSKA Online Shop website, introduce new Products, start and call off promotions on IKA POLSKA Online Shop or introduce changes thereto. The above right shall not affect the prices of Products ordered before the effective date of any change of price, conditions of promotions or sales.

8. Delivery

8.1. Products are delivered in the manner selected by User and specified in the purchase order. Shipment cost shall be added to the purchase order, according to the shipment price list valid on the date of placing the order by User. Current table containing information on delivery cost is available on the help site under the button "Delivery terms and conditions".

8.2. In case User orders untypical or high-value Products, the Seller may during the process of confirming the order demand a down payment or prepayment of the full value of the order, which shall be indicated in the terms of order completion. Such pre-payment shall be documented by VAT invoice issued by the Seller.

9. Lead Time

9.1. Lead Time shall cover the time of order preparation for shipment and delivery time.

9.2. A presumed time of preparation for shipment is indicated beside each Product. It is the time between the acceptance of an order and the time a package is shipped from IKA POLSKA Online Shop with the use of delivery method selected by the Buyer; please note that the stated dates refer to business days only. An Order for Products with different lead time will be sent as soon as the entire order is completed, and delivery date of such order is determined on the grounds of the Product with the longest lead time.

9.3. Delivery time is agreed pursuant to clause 5 - 7 paragraph IV of the TOS.

9.4. Orders are delivered by Poczta Polska (Polish Post) or courier service to the address indicated by the Buyer or are prepared for collecting at the Wholesale premises, at Buyer's choice made while placing an order.

9.5. Delivery method and time declared by delivery service providers for respective orders: Delivery methods and time within Poland:
a) Postal package, estimated delivery time – according to internal regulations of Polish Post. This service is provided by Polish Post on the grounds of the "Rules for providing general postal services" and the act "Postal Law", and respective regulations and implementing acts; b) courier service, estimated delivery time - 2 business days .
Delivery times indicated above are declared by Polish Post or a courier service.
c) collection from the Wholesale premises,
d) on the same business day after the order is confirmed by e-mail sent by IKA POLSKA Online Shop.

9.6. IKA POLSKA Online Shop shall not be responsible for non-delivery or delayed delivery of the Product caused solely by providing wrong delivery address by the Buyer.

10. Forms of Payments and Overpayments

10.1. Buyer may choose one of the following methods of payment for ordered goods to be delivered in the territory of Poland:
a) cash on delivery, in case the order is delivered by Polish Post or courier service;
b) cash, in case the order is collected in person at the Wholesale premises
c) bank transfer from any bank or by postal order to the following account:

regardless of the form of delivery/collection.

10.2. In case of some Products, due to their properties or value, IKA POLSKA Online Shop reserves the possibility to exclude some delivery or payment methods. Detailed information with this regard shall be included in Product description.

11. Complaints about Products

11.1. Complaints regarding purchased goods:

11.1.1. The Seller shall be liable towards the Customer according to the rules specified in the Civil Code of 23rd April 1964 (Journal of Laws No. 16, item 93 as amended) and other applicable legal regulations.

11.1.2. The fact that goods purchased by the Customer are inconsistent with the agreement or are not free from faults has to be reported to the Seller and, if needed, the goods complained about should be delivered to the Seller to the address: IKA POLSKA, 61-362 Poznań ul. Forteczna 19

11.1.3. It is recommended that all complaints should be made in writing or sent by e-mail to sklep@ika.pl. In order to accelerate and facilitate the process of handling a complaint, it is recommended that it should include all additional information, such as PO number, date of sale, etc.

11.1.3.1 Complaints are handled forthwith, however not later than within 14 days.

11.1.3.2. A response concerning the complaint shall be sent to the address provided by the Customer or in another way indicated by the Customer.

11.1.3.3. The Seller informs that in case of Products which are also covered by guarantee, any rights related thereto shall be exercised according to the terms and conditions specified in the guarantee card. The guarantee for the Product sold shall not exclude, limit or suspend Customer's rights as regards the Seller's liability within the scope specified in the Civil Code of 23rd April 1964 (Journal of Laws No. 16, item 93 as amended)

11.1.4. In order to facilitate the complaint procedure, the Consumer may use the complaint form made available by the Seller.

11.2. Complaints related to rendering e-service by the Online Shop:

11.2.1. Any complaints related to rendering e-service by the Online Shop shall be sent to the e-mail address sklep@ika.pl, or by post to the shop's address:

11.2.2. In order to facilitate and accelerate the handling of complaint, it is recommended that the message specified under item 1 contains such information as e-mail address, type and date when the irregularity has occurred and contact details.

11.2.3. Complaints concerning rendering e-services are handled forthwith, however not later than within 14 days.

11.2.4. A response concerning the complaint shall be sent to the e-mail address provided by the Customer or in another way indicated by the Customer.

12. Right to withdraw from the agreement

12.1. The Customer being also a consumer, as provided for in Art. 22[1] of the Civil Code of 23rd April 1964 (Journal of Laws No. 16, item 93 as amended), who concluded a remote agreement is entitled to withdraw from the agreement without stating his or her reasons, by submitting a statement to this effect within fourteen (14) days. To keep the deadline it is sufficient to send the statement before its expiry. The statement may be sent to the following address:

12.2. This fourteen-day deadline within which a Consumer is entitled to withdraw from a sales agreement or agreement on rendering e-service, shall run from the date of handing the Product over, in case of sales agreement, and if the agreement concerns rendering e-service - from the date of its conclusion.

12.3. As soon as the Seller receives the statement on withdrawal, the Seller sends to the Consumer an e-mail with confirmation of receipt of the statement.

12.4. In case an agreement is rescinded - the sales agreement or agreement on rendering e-service is not considered to have been concluded. The subject matter of service shall be returned in unchanged condition, unless the change was necessary to confirm the nature, features and functioning of a given thing, or § 12.7 of the TOS shall apply. Returns must be made forthwith, however not later than within fourteen days.

12.5. The Seller shall reimburse payments received from the Consumer applying the same method of payment that was applied by the Consumer, unless the Consumer explicitly agrees to another form of reimbursement, at no additional cost to the Consumer. The Seller may postpone the reimbursement of payments received from the Consumer until the Seller receives back the purchased goods or until the Consumer sends a copy of confirmation of sending them back, whichever comes first.

12.6. The Consumer shall only incur the direct cost of returning goods to the Seller.

12.7. If the Consumer has chosen a method of delivery other than the cheapest regular method of delivery offered by the Seller, the Seller shall not be obliged to reimburse the additional costs incurred by the Consumer

12.8. The Consumer shall be held liable for the reduced value of an object in the result of using it beyond the manner necessary to check the nature, features and functioning of that object.

12.9. The right to withdraw from a remote agreement shall not be granted to the Consumer in following cases:

12.9.1. in case of a service agreement, if the service has been completely performed by an entrepreneur upon explicit consent of the consumer who had been made aware prior to the commencement of the service that as soon as the service was rendered, the consumer should not have the right to withdraw;

12.9.2. in case of an agreement, where the price or remuneration shall depend on the fluctuations on the financial market which are beyond control of the entrepreneur and which may occur before the right to withdraw has expired;

12.9.3. in case of an agreement whose subject matter is a non-prefabricated thing, manufactured according to consumer's specification or to satisfy consumer's individual needs;

12.9.4 in case of an agreement whose subject matter is an object which deteriorates quickly or has a short best before date;

12.9.5. in case of an agreement whose subject matter is a thing delivered in sealed package which after its opening cannot be returned for health protection or hygienic reasons, if the package has been opened after the delivery;

12.9.6. in case of an agreement whose subject matter are things which after the delivery, due to their nature, are inseparably connected with other things;

12.9.7. in case of an agreement whose subject matter includes alcoholic drinks whose price has been determined upon conclusion of the sales agreement, and which can be delivered no sooner than after 30 days and whose value depends on the fluctuations on the market which are beyond control of the entrepreneur;

12.9.8. in case of an agreement in which the consumer explicitly demanded that the entrepreneur visited the consumer to perform urgent repair or maintenance; if the entrepreneur renders other services than the one requested by the consumer, or delivers other things than spare parts required for the repair or maintenance, the consumer shall have the right to withdraw only with regard to these additional services or things;

12.9.9. in case of an agreement whose subject matter are sound or visual recordings or computer software delivered in sealed packages, if the package has been opened after the delivery;

12.9.10. in case of an agreement on delivery of newspapers, periodicals or magazines, except for a subscription agreement;

12.9.11 in case of an agreement concluded by way of a public auction;

12.9.12. in case of an agreement for rendering services within accommodation, other than for residential purposes, transportation of goods, car rentals, catering, services related to leisure, entertainment, sports or cultural events, if the agreement specifies the date or period when such service is to be rendered;

12.9.13. in case of an agreement on supply of digital content which is not recorded on any material data carrier, if rendering the service commenced upon explicit consent of the consumer prior to the deadline to withdraw and notification by the entrepreneur that the consumer has no longer the right to withdraw.

12.10. The Seller shall provide the Consumer with an instruction on the right to withdraw, on a material data carrier, upon delivery of the purchased goods at the latest.

13. Complaints about Service

13.1. User may complain about Services rendered by Administrator, if such Services are not rendered or are rendered contrary to the provisions of TOS.

13.2. Complaints may be submitted in writing and sent with registered letter to the address of IKA POLSKA Online Shop indicated under item 1.3. of TOS, or with the use of the contact form available under the button Contact. Each complaint should contain at least identification of the User (especially login) and description of the reservations made.

13.3. Should the information given in the complaint need supplementation, as soon as the complaint is received and prior to its being handled, Administrator will ask the complainant to supplement the complaint as required.

13.4. A complaint is deemed received on the day it is received by Administrator in the proper form, with all required elements included and no supplements needed.

13.5. Administrator will handle complaints within 14 business days of the date of receipt thereof in the correct form, with the reservation however that the Administrator may refuse to investigate complaints submitted after 60 days from the occurrence of circumstances giving rise to the complaint.

13.6. A response to the complaint after its being handled by the Administrator will be sent to User's e-mail account indicated by the User during Registration.

14. The role of Administrator and rights and obligations of User

14.1. The use of User's Account by third persons and the use of other Users' Accounts is forbidden.

14.2. Administrator allows User to use IKA POLSKA Online Shop by connecting to Administrator's server through the Account made available to the User.

14.3. User is forbidden to use IKA POLSKA Online Shop contrary to the law, the principles of social co-existence or in a manner violating reasonable interests of Administrator.

14.4. User is obliged to keep the password and login secured and not to disclose it to third parties.

14.5. Administrator reserves the right to block access to one, several or all User's Accounts or to suspend (block) the possibility to use respective functionalities of IKA POLSKA Online Shop, in cases referred to in TOS. Blocking the possibility to use the Account (a block on the Account) and blocking the possibility to use certain functionalities of IKA POLSKA Online Shop cause that no operation can be made with the use of the blocked Account.

14.6. Administrator may block, for a specified or unspecified term, one, several or all User's Accounts or block the possibility to use certain functionalities of IKA POLSKA Online Shop in case User's actions or omissions are in breach of the provisions of these TOS, have adverse effect on Administrator's reputation or otherwise harm the Administrator.

14.7. User shall be fully liable for his or her acts or omissions giving rise to blocking User's Account, and in particular shall be fully liable for damages towards Administrator.

14.8. User whose Account has been blocked is not allowed to Register anew in IKA POLSKA Online Shop without prior consent from Administrator.

14.9. Administrator undertakes to provide highest quality service to Users, however, he shall not be liable for the consequences of improper use or impossibility to use IKA POLSKA Online Shop by the User for reasons beyond reasonable control of Administrator, and in particular due to Force Majeure circumstances, equipment failure or illegal intervention of Users, even if they result in the loss of data provided by the Users.

14.10. Administrator reserves the right to modify the contents of IKA POLSKA Online Shop at his own discretion.

14.11. User hereby consents to signing in to User's Account by persons appointed by Administrator for the purpose of proper technical handling of the Account (in particular in order to support the User).

15. Privacy Policy

15.1. Within rendering e-Services which require providing personal details, Administrator is entitled, according to Art. 18 clause 8 of the act dated 18th July 2002 on rendering e-services (Journal of Laws of 2002, No. 144 item 1204, as amended), to process personal details of Users required to effect, adjust the contents, amend or terminate the agreement on rendering Service by Administrator and exclusively for the purpose of proper performance of Services.

15.2. Should Administrator become aware that User uses IKA POLSKA Online Shop in the manner contrary to the applicable law or TOS, Administrator is allowed to process User's personal data for the purpose and within the scope required to determine User's liability.

15.3. Administrator is in particular allowed to process the following personal details: User's surname, name(s), alias and e-mail address.

15.4. Administrator is also allowed to process the following data used to characterize the manner in which Service is used by the User (operating data): User's identifiers assigned to the User on the basis of data provided, markings identifying the terminals of telecommunication system or IT system used by the User, information on the start and end and each use of Services, information on the use of Services by the User.

15.5. Administrator is the administrator of personal data in the meaning of the act of 29th August 1997 on personal data protection (Journal of Laws 2002, No. 101, item 926 as amended).

15.6. Administrator shall exercise due care in selecting and applying appropriate technical and organisational measures to ensure protection of personal data provided by Users. Such data is protected against unauthorized access by third persons, including taking it away by unauthorized persons, processing contrary to the applicable regulations and its modification, loss, damaging or destroying.

15.7. User shall have the right to view and modify his or her personal data.

15.8. Users' personal data or information concerning the same may be disclosed to the entities authorized to receive it by virtue of the applicable regulations, including the appropriate judicial authorities.

15.9. Administrator is allowed, pursuant to Art. 31 of the act on personal data protection, to entrust other entities with User's personal data processing, in particular the entities rendering hosting services.

15.10. Administrator uses "cookies". Information collected with the use of "cookies" allow adjustment of the service and contents to individual needs and preferences of Users, and is used for general statistic purposes concerning the use of IKA POLSKA Online Shop by its Users. Switching off the option allowing saving "cookies" in the Internet browser may disable the use of IKA POLSKA Online Shop.

16. Amendments to the TOS and Termination

16.1. Administrator reserves the right to amend these TOS at any time.

16.2. User shall be notified of any change in TOS among other by appropriate communication published on the IKA POLSKA Online Shop website.

16.3. Valid TOS are published on IKA POLSKA Online Shop website and is made available to User, free of charge, and upon each demand.

16.4. Any amendment is effective on the date indicated by Administrator, however not earlier than after 7 (seven) calendar days from the date of publication of the amended TOS on IKA POLSKA Online Shop website, with the reservation, that any transaction commenced before the amendments have become effective shall be performed under the so far terms.

16.5. User may refuse to accept the amendments of TOS by sending to Administrator, through the contact form, a statement on refusal to accept the amendments within 14 calendar days of the date of notification of the User about such amendment by Administrator. Non-delivery of the refusal to accept the amendments within the deadline specified above, shall be considered an acceptance of the amendments by the User.

16.6. The statement of refusal to accept the amendments sent to Administrator within 14 days of User's notification by Administrator on the amendment of TOS is tantamount with termination of the Agreement by the User upon 14 days' notice effective at the end of calendar month and calculated from the date the information on refusal to accept the amendments has been received by Administrator. During termination period User shall be bound by TOS in the version valid prior to the amendment.

17. Closing Provisions

17.1. These TOS shall take effect on the day they are published on IKA POLSKA Online Shop website.

17.2. In case any provision hereof is declared by a final and binding decision of a court invalid or impossible to enforce, it shall be excluded from these TOS and shall not affect the validity and enforceability of the remaining provisions.

17.3. These TOS shall be governed by Polish law. Any disputes arising in relation to Services provided by Administrator within IKA POLSKA Online Shop shall be solved by common Polish courts of competent subject matter jurisdiction.
